Falcon ExoDynamics, Inc. (“Company,” “we,” “us,” or “our”) provides engineering, technical, and related services to U.S. government and commercial customers in the space and aerospace sectors. This Privacy Policy (“Policy”) describes how we collect, use, disclose, and protect personal information, including in connection with our public website located at falconexodynamics.com (the “Site”).

Company does not offer consumer products or services, and the Site is not designed to collect personal information from members of the general public in a consumer capacity. The categories of personal information we collect through the Site are limited to: (a) information about job applicants and candidates; (b) information about business contacts, such as representatives of our government customers, prime contractors, subcontractors, and suppliers; and (c) limited information related to current employees who access Site-linked systems. This Policy does not apply to the general public as consumers, and we do not knowingly collect personal information through the Site from individuals in a consumer context.

1. Scope of This Policy

  • This Policy applies to personal information collected by Company, including through the Site, including our careers/job application pages, general contact and “request information” forms, event or webinar registration pages, and newsletter or mailing-list sign-ups, if offered.
  • This Policy does not apply to information Company collects or processes in connection with performance of government or commercial contracts (for example, Controlled Unclassified Information, program data, or personnel data processed through internal HR or security systems), which are governed by applicable contract terms, internal policies, and law, including as applicable NIST SP 800-171, CMMC, and FAR/DFARS requirements.
  • Current employees should refer to Company’s internal Employee Privacy Notice and employee handbook for a complete description of how their employment-related personal information is collected, used, and protected; this Policy addresses only personal information collected through the public Site or otherwise from third parties (aside from the Company’s government or commercial contracts).

2. Information We Collect

2.1 Job Applicants and Candidates

  • If you apply for a position with the Company, we collect information you submit as part of your application, which may include your name, contact information, resume/CV, work history, education, references, and responses to screening questions.
  • Because many Company positions require U.S. government security clearance eligibility or are subject to U.S. export control laws (ITAR/EAR), we may also collect citizenship status, immigration/visa status, and related information necessary to determine eligibility for a position or to comply with export control and security clearance requirements. This information is collected and used for these specific legal-compliance purposes.

2.2 Business Contacts

  • If you are a representative of a current or prospective government customer, prime contractor, subcontractor, supplier, or other business partner, we may collect your name, business title, employer, business email address, business phone number, and the content of any inquiry, proposal correspondence, or other communication you submit (for example, through a “contact us” form, capability statement request, or event/webinar registration).

2.3 Employee-Facing Information

  • If the Site provides links to internal systems (such as an employee portal, benefits system, or single sign-on page), the Site itself may collect only limited technical information necessary to direct you to the appropriate internal system; substantive employment data is collected and governed through those internal systems and the internal Employee Privacy Notice, not through this Policy.

2.4 Information Collected Automatically

  • As with most websites, we and our service providers automatically collect certain technical information when you visit the Site, such as IP address, browser and device type, pages viewed, referring/exit pages, and date/time of access, through server logs, cookies, and similar technologies, as described in Section 7.

3. No Consumer or Customer Data Collection

  • Company does not sell products or services to individual consumers, and the Site is not designed or intended to collect personal information from individuals acting in a consumer capacity.
  • If you are a point of contact at a government agency or commercial customer organization, information about you is collected and treated as Business Contact information under Section 2.2, not as consumer data.

4. How We Use Information

We may use the information we collect in the following ways:

  • To evaluate and process job applications and recruit for open positions, including assessing eligibility for positions subject to security clearance or export control requirements;
  • To respond to business inquiries, proposal-related communications, and requests for information from government customers, prime contractors, subcontractors, and suppliers;
  • To manage event registrations, webinars, or similar business communications, where offered;
  • To operate, secure, and improve the Site, including through analysis of automatically collected technical data described in Section 2.4;
  • To comply with applicable law, including export control laws (ITAR/EAR), U.S. government contracting requirements, and security clearance processes; and
  • To protect the rights, property, and safety of Company, our personnel, our customers, and others.

5. How We Share Information

We do not sell personal information collected through the Site.

We may share personal information as follows:

  • With U.S. government agencies and customers, and prime contractors, where necessary to perform a government contract, support a proposal, or comply with a security clearance sponsorship, background investigation, or export control compliance process;
  • With service providers who perform functions on our behalf, such as applicant tracking system providers, IT hosting providers, and website analytics providers, under contractual confidentiality and data-protection obligations;
  • With professional advisors, such as legal counsel and auditors, as necessary;
  • As required by law, regulation, legal process, or governmental request, including export control and national security-related inquiries; and
  • In connection with a merger, acquisition, financing, or sale of company assets, subject to standard confidentiality protections.

6. Export Control Notice

  • Certain positions and business activities are subject to the International Traffic in Arms Regulations (ITAR) and/or the Export Administration Regulations (EAR). Where applicable, we collect and use citizenship, place-of-birth, and related information solely to determine “U.S. person” status and eligibility to access controlled technical data, in compliance with these regulations.
  • Information collected for export control compliance purposes is used and disclosed only as necessary for that purpose and as otherwise described in this Policy.

7. Cookies and Similar Technologies

  • The Site may use cookies and similar technologies for core functionality, security, and website analytics. We do not use the Site to serve targeted or cross-context behavioral advertising.
  • You may be able to manage cookies through your browser settings; disabling cookies may affect certain Site functionality.

8. Data Security

  • We use administrative, technical, and physical safeguards designed to protect personal information collected through the Site, consistent with Company’s information security program and applicable government contracting security requirements.
  • No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Data Retention

  • We retain job applicant information for the period necessary to evaluate your application, comply with recordkeeping obligations applicable to government contractors (including as may be required by OFCCP or similar regulations), and defend against potential claims, after which it is deleted or de-identified in accordance with our retention practices.
  • We retain business contact information for as long as reasonably necessary to maintain the business relationship and for legitimate business and legal purposes thereafter.

10. Your Privacy Choices and Rights

  • Depending on your state of residence, you may have rights to request access to, correction of, or deletion of certain personal information we hold about you, and to receive information about our collection and disclosure practices.
  • Because we do not sell personal information collected through the Site and do not use it for cross-context behavioral advertising, no “Do Not Sell or Share” opt-out is generally necessary to give effect to those preferences.
  • Certain requests may be subject to exemptions where personal information is necessary to comply with export control law, security clearance processes, government contract obligations, or recordkeeping requirements applicable to government contractors.

11. Children’s Privacy

The Site is intended for business and employment-related use by adults and is not directed to children. We do not knowingly collect personal information through the Site from children.

12. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will post the updated Policy on the Site with a new “Last Updated” date. Your continued use of the Site after the effective date of a revised Policy constitutes your acknowledgment of the changes.
